Terms & Conditions

Last updated: June 2026. Please review these terms with qualified legal counsel before relying on them.

These Terms & Conditions (“Terms”) govern your access to and use of the CertifyAmerica website and online courses (the “Services”), operated by CertifyAmerica (“we,” “us,” or “our”). By creating an account, purchasing a course, or otherwise using the Services, you agree to these Terms.

1. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least the minimum age required by your jurisdiction to use the relevant training.

2. Courses and certificates

Our courses are intended to help you meet applicable training requirements. We make reasonable efforts to keep course content aligned with current state agency requirements; however, requirements change, and final approval, licensing, or acceptance of any certificate is determined solely by the applicable agency. A certificate of completion confirms that you finished the course and does not guarantee licensure or any specific outcome.

3. Payment

Prices are listed in U.S. dollars and are charged at checkout through our payment processor. You authorize us and our processor to charge your selected payment method for the total amount shown, including any applicable taxes.

4. Refunds

Purchases are subject to our Refund Policy, which is incorporated into these Terms.

5. Acceptable use

You agree not to share, resell, or redistribute course access or materials; not to attempt to complete a course on behalf of another person; and not to interfere with or misuse the Services. Course content is provided for your individual use only.

6. Intellectual property

All course materials, text, graphics, and software are owned by CertifyAmerica or its licensors and are protected by intellectual-property laws. We grant you a limited, non-transferable license to access the content you purchase for your own training.

7. Disclaimers

The Services are provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free, or that any course will satisfy a particular legal requirement in your specific circumstances.

8. Limitation of liability

To the fullest extent permitted by law, CertifyAmerica will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid for the course at issue.

9. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. [Insert legal entity name, address, and any dispute-resolution or arbitration terms here.]

10. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
